1. Nature of This Statement
This site, ohyeah.love (the "Site"), makes the following statement of compliance and exemption with respect to the recordkeeping requirements arising under Sections 2257 and 2257A of Title 18 of the United States Code (18 U.S.C. §2257 / §2257A) and their implementing regulations (28 C.F.R. Part 75).
The Site is a curation and review platform for third-party adult content. By reason of its operating model, the Site is not a "producer" as defined for the purposes of §2257 — it is neither a primary producer nor a secondary producer — and it is therefore not subject to the age-verification recordkeeping and labeling obligations that §2257 imposes with respect to visual depictions of actual sexually explicit conduct. The basis for this exemption is set out in Section 3 below.
2. What This Site Does and Does Not Do
To define the Site's legal position with precision, the following facts are stated (these descriptions reflect the core facts of the Site's actual operations, and all compliance determinations are made on this basis):
The Site does NOT:
- produce, film, direct, orchestrate, or create any visual content;
- host, store, upload, or transmit any adult video or sexually explicit media files themselves;
- accept user-generated uploads of any kind — the Site contains no functionality enabling the public to upload imagery;
- edit, transcode, re-edit, or republish any third-party imagery.
The Site does ONLY the following:
- writes independent reviews, ratings, and index metadata for adult videos already publicly published on third-party source sites;
- directs visitors to the original source sites to view content, by way of outbound links in the body text bearing the
rel="sponsored nofollow"attribute; - caches on the Site's own servers only the cover thumbnail, used as the visual identifier of a review entry (see Section 4 for the dedicated discussion of thumbnails).
3. Basis for Exemption
3.1 The Site Is Not a "Primary Producer"
Under 28 C.F.R. §75.1(c)(1), a "primary producer" is a person who actually films, records, digitizes, or otherwise creates a visual depiction of actual sexually explicit conduct. The Site engages in no such act of creation and therefore does not constitute a primary producer.
3.2 The Site Is Not a "Secondary Producer"
Under 28 C.F.R. §75.1(c)(2), a "secondary producer" is a person who publishes, reproduces, reissues, or otherwise inserts a visual depiction of actual sexually explicit conduct into a computer site or into other matter. The Site does not publish, reproduce, reissue, or insert any sexually explicit depiction into its own pages — no sexually explicit media file subject to §2257 exists on the Site's pages; a visitor can encounter such depictions only after actively clicking an outbound link, leaving the Site, and arriving at the third-party source site. Accordingly, the Site does not constitute a secondary producer.
3.3 Exemption for Pure Linking / Indexing Activity
Under 28 C.F.R. §75.1(c)(4) (and the related line of authority, including the boundary established by Sundance Associates v. Reno and its progeny), a person who merely provides links, references, indexing, or a pathway to the content of others, without actually producing or inserting the depictions, does not thereby become a producer within the meaning of §2257. The Site's reviewing of, and outbound linking to, third-party content falls squarely within this exempt category.
3.4 Note on §2257A(h): Text-Only Content and Lawful Commerce
The content generated by the Site itself consists of text-based reviews, ratings, and metadata and contains no sexually explicit depictions created by the Site. With respect to the Site's own output, no visual-depiction recordkeeping obligation arises under §2257 / §2257A.
4. Note on Cached Cover Thumbnails
The cover thumbnails cached locally by the Site are sourced from cover images publicly displayed by third-party source sites and serve solely as identifying visual markers for review entries. With respect to those thumbnails, the Site states:
- the thumbnails were not created or photographed by the Site; the Site is not their primary producer;
- the Site's cached display of thumbnails is indexing / referential in nature, serving to point to and comment on third-party content; the Site does not regard them as sexually explicit depictions "inserted" by the Site within the meaning of §2257;
- responsibility for whether any individual cover image contains sexually explicit content subject to §2257, and for maintaining the corresponding age-verification records, rests with the original producer who created and first published that image (see Section 5);
- should any thumbnail be alleged to be non-compliant, the Site's notice-and-takedown and CSAM internal-control procedures apply (see Section 6).
The Site will keep its treatment of cached thumbnails under continuing review and reserves the right to adjust it where necessary (for example, by switching to hotlinking only, further cropping, or removing explicit elements).
5. Where the §2257 Records Reside
For all third-party visual content reviewed, indexed, and linked by the Site, the original producers of that content and the source sites hosting it are the producers as defined by §2257 / §2257A, and the obligations to maintain and make available age-verification records rest entirely with them. The corresponding §2257 compliance statements and Custodian of Records information should be consulted on each original source site itself.
The Site advises visitors: to view the §2257 recordkeeping statement applicable to any depiction, please proceed to the page of the original source site to which the Site's outbound link points and consult that site's own compliance statement.
6. Age Gate, Zero-Tolerance CSAM, and Takedown
Although the Site is lawfully exempt from the recordkeeping obligations of §2257, it nonetheless proactively enforces the following internal controls to exclude any content connected with minors:
- Entry age gate: visitors must confirm that they have reached the legal age of majority (the Site records this confirmation in localStorage); the Site's content is intended for adults only;
- Draft-only harvesting + human publication gate: every indexed entry is first created as a draft and may go live only after human review;
- Auto-takedown for suspected minors: any entry flagged as potentially involving a minor is automatically taken offline immediately upon flagging;
- Permanent bans for bad sources: violating source sites are permanently removed from the index;
- Zero tolerance: the Site maintains zero tolerance for child sexual abuse material (CSAM) in any form and will report it, as required by law, to the competent authorities and relevant organizations (NCMEC in the United States; the corresponding competent bodies in other jurisdictions).
If you believe that any review entry, outbound link, or cached thumbnail on the Site involves non-compliant content, please submit a notice pursuant to the Site's DMCA / Notice-and-Takedown Policy and Reporting & Abuse Policy pages, or contact the records/compliance contact set out below directly.
